Reports on the recent case "Kensington and Chelsea Royal Borough Council v Secretary of State for Communities and Local Government" which provides some welcome clarity to permitted development rights involving constructing or enlarging basements. Ruled that permitted development rights can apply to below-ground development. These rights may not apply in certain circumstances where 'the enlarged part of the dwellinghouse would have been more than one storey'.
