"National Home Loans Corporation plc v Giffen Couch & Archer" QBD 6 December 1996. A solicitor instructed by both a lender and a borrower on a remortgage was under duty to inform the lender if he discovered that the borrower had a poor repayment record with a previous lender. Claim by plaintiff allowed.
