In "Burn v North Yorkshire CC" LT 5 September 1991, the LT held that the claimant`s blight notice against the purchasing highway authority was valid and effective despite abandonment of proposals to build a relief road through part of his property. Whilst it was clear that the blight had been lifted by the date of the hearing, the highway authority disputed whether the date and the terms of the counternotice were still binding. LT accepted that the highway proposal had affected marketability of the remainder of the property not required for the relief road extension.
