In considering an appeal against the Inspector`s refusal to grant planning consent in "Portswood Developments Ltd v SOS for the Environment and another" QBD 2 October 1991, it was held that after refusing consent for a business development on land restricted to residential use, the Inspector failed to take into consideration that the council had resolved to approve a proposal for a hotel development on the same site. Application allowed. Applied "Bolton Manchester BC v SOS for Environment" (1991 JPL 241).
