In Southern Water Authority v Nature Conservancy Council QBD 24 May 1991 in an appeal against a cc decision , it was held that Wildlife and Countryside Act 1981 S28 was not directed at an owner or occupier of a part of land within a site of special scientific interest when the occupier was carrying out specified works on some other part of the SSSI not owned or occupied by him. Appeal allowed, reversing cc decision reversed.
