"R v Kensington and Chelsea Royal LBC ex parte Europa Foods Ltd" QBD 15 January 1996. E was a tenant of C who occupied adjoining premises. E sought a new business tenancy but C served a counter-notice that it intended to use the premises for its own business and obtained a certificate of lawful proposed use on the grounds that planning permission for change of use was not required. E sought judicial review against the local planning authority. "Held" that application for judicial review was refused.
