In Jacks`s Executrix v Falkirk DC Court of Session Second Division 30 January 1991, it was held that the exectrix of a deceased who purchased her local authority house under Housing (Scotland) Act 1987 Part III but to whom a deposition had not been delivered, was not entitled to demand a conveyance of the house to her, without granting a standard security for repayment of the statutory discount.
