QBD 11 December 1987. An application under Wildlife and Countryside Act 1981 by two officers of the Ramblers Association concerning an order, Lincolnshire County Council No.2 Modification Order 1985 made under s53, which purports to delete from the definitive map and standard of an area, a footpath which had appeared on the said map since 1959. The defendants claimed there had never been a footpath and it therefore should never have been shown on the map. It was held that this was not relevant, if the footpath had appeared on the map it could not be deleted.
