The CC decision in Waltham Forest LBC v Thomas CA 12 February 1991, was upheld by the Appeal Court saying that the Housing Act 1985 S87 dealing with succession to a secure tenancy on a tenant`s death does not apply to a brother residing with a tenant throughout the period of 12 months ending with tenant`s death but not in same local authority premises.
