Adverse possession - starting and stopping

Wilkinson, H. W.

Adverse possession - starting and stopping - 1988 - New Law Journal 138(6351) 8 April 1988, 238-241(4) .

Considers the recent case BP Properties Ltd v Buckler (1987) (See Abstract 38290) which decided two points concerning the obtaining of a title to land by adverse possession . The first point was where proceedings recover possession of land commenced before expiration of the 12-year limitation period, the right to recover possession is not precluded because the limitation period has expired. The second and more unusual point was that where the owner of land gives the occupier the unilateral licence to remain in possession, adverse possession is defeated anyway.
