CA 2 December 1987. An appeal by the tenant from a decision in the county court where the judge had granted the landlords an order for possession . By an agreement in August 1983, the landlords let the tenant a protected shorthold tenancy for one year, the landlords to give three months written notice should they not wish to renew the tenancy for another term. A year later, after August 1984, as the landlords had not indicated that they wished to renew the agreement, or given any notice, and the tenant remained in occupation. The landlords brought proceedings for possession, alleging as a ground arrears of rent and also the mandatory ground for possession under Rent Act 1977 sched 15 case 19 . A possession order was made. The tenant applied to set it aside and when this was refused, the matter came to appeal. CA held, dismissing the appeal by the tenant, that the landlords had given the proper notices and there were no grounds for setting aside the judgment for possession.
