C & G Homes Ltd v SoS for Health CA 5 November 1990. The use of a private dwelling house as a home for patients released from hospital and suffering mental disorders was found to be in breach of covenant confining use of the houses only to that of a private dwelling. However, the court dismissed the claim that this use caused detriment to C & G Homes selling other homes on the estate.
