Demetriou v Poolaction Ltd and another CA 24 October 1990. An appeal by landlords concerning a repairing convenant was allowed. It was decided that a repairing covenant was not implied just because there was no express covenant and as the tenant was using the premises for subletting and the tenancy was not residential , the Housing Act 1961 did not apply.
