Summary, etc. This revised version of the OFT's 2001 guidance on how the Unfair Terms in Consumer Contracts Regulations 1999 apply to tenancy contracts is updated to reflect enforcement action taken by the OFT, court judgments and recent experience in dealing with tenancy contract complaint. The guidance outlines why some standard contract terms used in standard tenancy contracts are considered to be potentially unfair and includes examples of such terms and possible ways of revising them. It also refers to tenancy agreements used by public sector and social housing providers including local authorities, following court rulings that the1999 regulations apply to these providers. A consumer leaflet "Unfair tenancy terms - don't get caught out" giving a brief overview of the OFT's views on unfair terms in tenancy agreements has also been published.
