Summary, etc. CA 21 December 1995. G took out a consequential loss policy with N for the purposes of a redevelopment project. Under the policy< N agreed to indemnify G for loss of anticipated rent. The insurance was subject to a material damage proviso. In September 1995, a fire destroyed the architects office and severla documents including work-in-progress drawings whci were not insured. The development was delayed. G commenced proceedings against N and the judge held in favour of G that the drawings constituted property used by G within the meaning of the policy and that G had no insurable interest in them under the material damage proviso. N appealed, G cross-appealed. Both appeals dismissed.
