Summary, etc. [2005] EWHC 1705 (Admin), 6 July 2005. Two applications for planning permission were considered by a local authority, who were obliged to perform a comparative assessment of the planning merits of both schemes. The claimant applied for a judicial review following planning permission being granted to a rival developer claiming that this assessment should have been carried out by the BC. "Held": both developers were seeking permission to develop similar schemes in the same village. The rival developer argued that it had bought the land on the understanding that it had planning permission. The court was sympathetic, but C had made it's case before the purchase was completed.
