Aims to remove legal anomalies, inconsistencies and unnecessary complications while retaining the valuable distinction between these three types of property rights. Defines each one and considers their advantages. Advocates the replacement of current prescriptive methods of obtaining easements with one single method. Suggests rationalisation of the law of easement extinguishment. Proposes the creation of a new land interest, the land obligation, to replace positive and restrictive covenants. Responses are due by 30 June 2008.
