Summary, etc. QBD 8 June 1988 The plaintiffs (S) issued a summons against the defendants (M) applying for the discovery of certain documents in the possession of M which had formed part of the documentation in an arbitration between M and a third party. M claimed privilege for the documents on the ground that the documents used in different proceedings with different parties were privileged from production in other proceedings. Held that there is no general principle that the documents relating to the arbitration are privileged in other proceedings between a party and a party to the arbitration and a third party.
