Concerns a hearing on costs in an application by Claimant tenant Z against Defendant landlord C for relief from forfeiture under the County Courts Act 1983 s 139 in respect of a business lease. Z sought costs award against C on an indemnity basis contending that C's request for a formal application for relief as relief from forfeiture could have been effected and the lease continued. "Held": costs awarded against Z. C's physical re-entry of its premises ended the lease by operation of law. A lease once forfeited will remain so and until the lessee applies for relief under s139 of the 1984 Act.
