Summary, etc. DEFRA gives informal guidance on the recent HL judgment in Brandwood and others v Bakewell Management Ltd ([2003] EWCA Civ 23). The case overturns the judgment in the Hanning v Top Deck Travel ([1994] 68 P&CR 14) and means that many more people will be able to claim a prescriptive right of vehicular access. Where such a right exists, no application for a statutory easement under S68 of the Countryside and Rights of Way Act 2002 is necessary.
