Summary, etc. Discusses the effects of the Transfer of Undertakings (Protection of Employment) Regulations 1981 (TUPE) which implement the acquired rights directive (Directive 77/187/EEC). The regulations govern the transfer of employees contracts in the undertaking to the successor employer. Points out when TUPE applies and that "Schmidt v Spar und Leihkasse der Fruheren Amter Bordesholm Kiel und Cronshagen" (C392/92, [1994] IRLR 302) should be considered. Further, gives questions and answers to various points on this issue such as the effects of a transfer on employment contracts and the effect on TUPE law of individual cases.
