Summary, etc. Highlights the pitfalls for employers and contractors when looking at Contractor's All-Risks insurance (CAR). CAR is typically required to be taken out by the employer, developer or contractor at the start of a development and will usually protect against physical loss or damage to the works, construction plant and equipment or machinery. For existing buildings CAR will cover reinstatement of the new works and reinstatement of existing structure following specified perils such as fire or flood. Case law is used to illustrate where this type of policy does not always offer the type of cover it is thought to. Advises that parties should always check CAR has been taken out, check the policy is relevant, adequate and appropriate and should be aware of risks involved.
