Under the Water Resources Act 1991 s85 and the Groundwater Regulations 1998, companies and individuals can be fined for accidental spillages from vehicles and on-site accidents that pollute streams, rivers and other controlled waters and for leachate from landfill sites. This is illustrated by the case "Express Ltd v Environment Agency ([2004] EWHC 1710 (Admin)) where liability was imposed on a third party that was not directly responsible for the pollution.
