A building owner who had caused damage to the internal walls and floor slabs of two adjoining properties was not liable to compensate the adjoining owners for a longstanding defect to their external wall. His works had brought the defect to light, which made it necessary for them to do something about it, but it was not caused by him or his works, and the Party Wall etc. Act 1996 did not require him to pay for remedying it.
