Summary, etc. In Thrasyvoulou v SoS for the Environment and Another , CA 28 January 1988, the court allowed the plaintiff`s appeal from the previous decision, holding that, where, in 1982, a local authority instituted enforcement proceedings under the Town and Country Planning Act 1971 ss 36 and 38 against the owner for alleged breaches of planning control by change of use , and the owner appealed successfully, the local authority was estopped from issuing enforcement notices on the same properties in 1985 when there had been no change of circumstances in the meantime.
