Summary, etc. LT 7 September 1989. This decision concerned the question of whether interest should have been payable on the compensation agreed for the compulsory acquisition of property, a gentlemans outfitters. In September 1986 S served a blight notice on the council which was accepted. The value of the freehold interest was agreed to be £75,000 and disturbance £67,000 plus redundancy payments, surveyors fees and legal costs. The suggested completion date was 27 February 1987 and the tenant of the attached flat was served with a notice to quit active on that date. Problems arose over a piece of adjoining land owned by British Rail and used to accommodate a fire escape for the flat and the completion date was delayed. No mention of interest was made. Question arose as to whether the council had made an entry on to the land on 27 February or any subsequent date but before the date of compensation as under Land Compensation Act 1961 s32 and Land Compensation Act 1973 s63 .
