| Summary, etc. | ChD 31 July 1989. Claim by the lessee (L) against (H) for damages for breach of repair ing responsibilities in respect of her basement flat . L held the flat under a long lease. When the flat was surveyed a certain amount of damp was found but was not considered excessive. L found water had entered the flat and was causing damage to the flat and those adjoining. The cause of the damp was said to be broken guttering causing water penetration through cracks in asphalt below the water tanks. H promised to remedy the problem. A surveyor concluded that damage was caused by non-operating ball valves in the water tanks , At a later date these were replaced but the problem continued. L organised for repairs to be done and claimed recompense from H for the work. The judge considered H to be an unreliable witness since he tried to mislead the court as to his action and previous history. Judgement and damages awarded to L. |
