Summary, etc. In Groveside Homes Ltd v Elmbridge Borough Council , QBD 10 July 1987, it was held that the appellant company was not liable to conviction under the Town and Country Planning Act 1971 s102(1) for uprooting a tree which was subject to a tree preservation order . The offence had been carried out, contrary to strict instructions, by an unknown employee of contractors who were developing the land.
