| Summary, etc. | LT 10 October 1990. The Department of Transport D, compulsorily purchased the freehold interest in a section of land and another site, occupied for 775 days, for a road scheme . Both pieces of land formed part of the site of a former chemical works . The claimants P sought compensation for the land acquired, injurious affection for the retained land arising from noise from the road when built and for use and occupation of the temporarily acquired land. At the valuation date the whole site was contaminated by chemical pollution and some radioactivity. P`s predecessors in title had applied for planning permission for residential development . This was allowed subject to conditions including decontamination. P valued the land at £167,817 based on the £13m sale price of the whole site achieved in June 1988 adjusted to the valuation date by Housing Land Price Indices to give £199,783 on which an agreed hope value of 75% was applied leaving £149,837.
