Summary, etc. CA 11 February 1991. The tenants had breached their covenant by failing to carry out repairs , and the landlords peaceably re-entered. The lower court had held that there had been a breach, that the notice had been sufficient before re-entry , that the re-entry had constituted such, and that the court had no jurisdiction to grant relief . The final point was the subject of the appeal. Equitable jurisdiction as called for by the tenants was, it was decided, extinguished by legislation.
