The appellant won his appeal that he had a licence to occupy the room in the hostel under Housing Act 1985 s79(3) and was therefore entitled to security of tenure under Part IV of the Act. The appellant had been admitted to the hostel under an agreement entitled, "licence to occupy" and the provisions for the council to change the accommodation or put in an additional person had no effect on the appellant`s right to occupy the room.
