| Summary, etc. | CA 11 April 1991. The appeal site was used by the appellants, T, for the maintenance, report and servicing of buses, coaches and ancillary equipment. The site, within green belt, did not have planning permission as it was an established use. In 1988 T made an application for planning permission to demolish the existing buildings and erect a new workshop and ancillary offices. The District Planning Officer recommended approval but the authority refused the application on the grounds that, although the buildings on the site were run down, the new buildings would not bring about any improvement as they would be more intrusive. T`s appeal to HC was dismissed. T appealed to CA on the grounds that the new building would in fact be smaller. The inspector had not taken into account demolition of buildings outside the planned area for new buildings. The appeal was dismissed as the main new building was to be larger than the old main building. |
