| Summary, etc. | ChD 25 March 1992. P is the person entitled by assignment to the reversion expectant on determination of an underlease granted in June 1971. S is the lessee under the underlease granted for 97 years. The dispute is as to the true construction and effect of provisions for rent review. The lease allowed for 7-yearly rent reviews and for the new rent to be the fair rack rental market value. Problems arose at the second rent review in September 1989. Dispute arose as to the hypotheses to be made. D contends that the term of the hypothetical lease is the unexpired portion of the term on the basis of a lease with no provisions for rent review. S however contends that the term of the lease is seven years and that it must be assumed that any letting for a longer period is on terms which provide for rent reviews at a period of seven years or at some similar period.
