Summary, etc. The judgement in Colchester BC v Smith and others HC illustrates that whilst a title to ownership of land can be acquired by adverse possession , the original owners title can be revived by means of estoppel . Held that council landowner was freehold owner and that the tenant was not entitled to any interest in the land except the 1983 agreement in the form of a protected tenancy under the Agricultural Holdings Act.
