Para 8 of the order required S to pay a percentage of the difference in value when the subject land was sold for development as in "Stokes v Cambridge". In 1993 the land was sold for development and S brought judicial definition of development gain for the purposes of para 8. Held that the serviced plot basis of valuation be adjusted.
