| Summary, etc. | CA 19 October 1992. The defendants (C) were instructed by the plaintiff (K) to sell his house, commission to be a percentage of the selling price. C were also instructed to sell the property next door. An offer by a prospective buyer for the adjacent property was accepted. He then offered to buy K`s house. C did not inform K of the agreement to buy the other house and K accepted the offer. Sales of both houses were completed. K instituted proceedings against C to claim damages for breach of duty and conflicts of interest. C counterclaimed for their commission. K were awarded damages and declared C were not entitled to commission. The Court of Appeal of Bermuda allowed C`s appeal. It was "held" that it was the business of estate agents to act for numerous principals, several of whom might be competing and whose interests would conflict. |
