| Summary, etc. | HL 21 January 1993. S67 of a contract to build the cooling system in the Channel Tunnel provided for disputes to be heard by a panel of experts and for resolution by arbitration in Brussels. Dispute arose, over the value of variations, an eventuality anticipated by s67. B threatened to halt work claiming that C was in breach of contract. C sought an injunction to prevent B`s suspension of work. C`s attempt to stay B`s action in favour of arbitration under the Arbitration Act 1975 was quashed. It was reinstated by the Court of Appeal. However, B`s position was reasserted when the case reached HL. The judgment clarified the operation of the Arbitration Acts when hearings are held abroad. |
