| Summary, etc. | LT 27 May 1994. B compulsorily purchased X`s freehold interest in a piece of derelict land. X had the benefit of a right of way to the main road over land owned by a third party. Various planning permissions had been issued on the land. X put forward two approaches to valuation claiming £1,235,000 in respect of land taken, one based on valuation of the land in its current unreclaimed state with planning permission and the second based on the value of the land for built development following reclamation and with the benefit of improved access. B claimed there was no planning permission current on the site for the use mentioned and that cheaper access routes could be built. LT held that the valuation should be £609,774 based on £600,000 for the freehold interest and £9,774 for the costs of preparing the claim. |
