Summary, etc. LT 30 November 1992. Claim for compensation under Land Compensation Act 1973 s1 for depreciation in the value of land by physical factors caused by the use of public works. Land adjacent to V`s property was a public car park set up under Road Traffic Regulation Act 1984 s32. Held that s32 was permissive and did not expressly or by implication confer immunity on D from actions in nuisance within the meaning of the 1973 Act so as to entitle V to compensation. Preliminary point of law determined in D`s favour with £500 costs.
