Summary, etc. HL 24 June 1993. The parties were joint owners of a house, registered solely in T`s name to facilitate a DSS fraud by M. Following an argument, T moved out, claimed possession and gave M notice to quit . T`s reliance on the illegality of the arrangement to prevent a successful defence was thwarted in the courts. HL upheld earlier decisions that the fraud was not sufficient to undermine M`s claim for a half share in her house. (see Abs46470)
