Mrs Ashman remained in the married quarters as she could find no alternative accommodation. The contention regarded the calculation of the mesne profit - whether it should be calculated on local authority rent figures or open market rent. Appeal "held" that the damages should be based on the value of the benefit to Mrs Ashman; case remitted to the County Court.
