"Interallianz Finanz AG v Independent Insurance Co Ltd and others" QBD 5 June 1997. Prior to making a loan to a property company (X) to purchase a property, I obtained an open market valuation of the property from the fourth defendant, who valued the headlease at £29.6m. X fell into arrears and the property was sold for £17.25m. I made claims under the mortgage indemnity insurance policies but insurers did not meet the claims. Proceedings commenced against first, second and third defenders as insurers and the fourth defendant for negligent valuation. Judgment for the plaintiff. |
