"Oates and others v Anthony Pittman & Co" CA 7 May 1998. Plaintiffs purchased property to let as holiday flats. Informed by Devon DC that planning permission was for hotel only, not holiday letting. P could not afford the costs of compliance with the building and fire regulations. Property sold. Proceedings against defendant solicitors alleging negligence, which D admitted but disputed amount claimed for damages. High Court ordered costs of £30,770. P appealed that award was too low. Appeal allowed. |
