| Summary, etc. | HL 29 July 1998. A husband and wife were joint tenants under an assured weekly tenancy until the wife left and began divorce proceedings. The wife served a notice to quit on the landlord however the husband continued to live there after the notice expired. The landlords commenced proceedings for possession and the husband sought an adjournment on the grounds that he intended to make an application under the Matrimonial Causes Act 1973 s24 to transfer the joint tenancy into his sole name. The judge refused the adjournment on the grounds that the application was too late. The Court of Appeal reversed the decision but the landlord`s appeal was upheld in the House of Lords. |
