Summary, etc. Rushmer & another v Countrywide Surveyors (1994) Ltd & another T & CC 9 July 1999. The defendant surveyor, C carried out a structural survey for the claimants (R) in 1994 and in light of the surveyor's report the transaction went ahead. R subsequently discovered severe structural defects and issued proceedings against C, claiming they had acted negligently. R claimed damages of £40,000, as the property was only worth £330,000, not the £370,000 paid. The surveyor admitted liability. Held R's claim was allowed. [1999]
