Applicant mortgagee, T, held a charge by way of a mortgage on a lease of a maisonette, the reversion which was owned by the respondent landlord, I. In 1990 T obtained a possession order against the lessess for mortgage arrears and by October 1997 had gained possession of the premises. I's solicitor then served a notice requiring repairs to be carried out on the property. In 1998, I claimed to have forfeited the lease by peaceable re-entry, relying on failure to pay ground rent and service charges. "Held" mortgagee entitled to relief from forfeiture upon payment of rent arrears and service charges.
