Summary, etc. CA 16 November 1999. In 1992 British Railways Board granted V a lease for six years, to use the premises as a car park. In 1994 following the privatisation of the railways, R became the landlord. In 1996 R sent a notice of termination under the Landlord and Tenant Act 1954 S25, stating that R would oppose the grant of a new tenancy on ground 30(1)(g) of the 1954 Act, because R intended to occupy the land for its own business purposes. It was held that R had a genuine intention of occupying the premises for business, and that R was entitled to object under ground (g) because its interest had not been created within the five-year period. Appeal dismissed.
