The claimant council issued proceedings seeking possession of the property. The defendant claimed right of possession and title to property by adverse possession. The judge found that physical possession did not constitute an intention to possess. The defendant appealed contending his actions of breaking and replacing the council's padlock demonstrated an intention to possess. "Held", appeal allowed on the grounds that the defendant's intentions should be judged on his actions.
