Summary, etc. CA 21 March 2001. Basten (B) sought leave to appeal against a ruling in favour of the defendant (Z) who had applied under CPR 3.4(2)(b) to strike out a re-amended statement of claim. B also sought an extension of time to appeal. "Held": The applications were dismissed on the grounds that extending the time to appeal would serve no useful purpose; that the CA only had the power to interfere where the judge was clearly wrong in his approach or conclusions; and that the judge had exercised his discretion correctly in considering the overriding objectives of CPR and the history of the case.
