| Summary, etc. | [2002] EWHC 2307 (Admin), 8 November 2002. London Underground Ltd (LUL) was in breach of planning control when construction commenced on the East London Line extension. LUL refused to make an undertaking, sought by the claimant (H), not to demolish Bishopsgate Goods Yard, a listed building. The question was whether the goods yard comprised of one building or several and if so, did the listing cover all of them. H applied for permission to bring about a judicial review proceedings to challenge LULs decision not to make an undertaking. It was decided that it was a matter for the local planning authorities to determine what, if any, enforcement action was appropriate. Held: the claim was allowed in part. |
